GENERAL TERMS AND CONDITIONS OF BUSINESS


§ 1 Area of application
Area of application: For all services rendered by and arrangements made by Miriam Bers GoArt!, Halle am Wasser - Invalidenstr. 50/51 D-10557 Berlin, Germany.

§ 2 Prices and Reservations
The range of services listed in the GoArt! pricelist are intended for small groups. Prices for custom tours are designed based on your requirements and should be considered a guide.
GoArt! charges value added tax (19%). Entry costs, transportation costs, and restaurants are not included in the price, although there may be exceptions.
A reservation is considered binding once it is confirmed by GoArt! according to the terms and conditions below. The customer is entitled to let another person use his or her reservation. A reservation can be canceled. Cancellations should be submitted in writing to provide written proof. Clients who are not the users of the services are liable for performance of all agreements along with the users of the services.

§ 3 Payments
GoArt! guided tours in Berlin:
Payment shall be made by wire transfer. As a rule, the total price must be paid at least 8 banking days before the tour. If reservations are made on short notice, a special method of payment shall be agreed.

GoArt! tours with further services:
Payment shall be made by wire transfer. As a rule, 50% of the amount shall be due at the latest 30 days before the agreed tour. The total price must be paid at least 14 days before the tour. If reservations are made on short notice, a special method of payment shall be agreed. Booked admission tickets (shows, Museums…) will be charged 100% up from the booking date

§ 4 Terms and conditions of cancellation
GoArt! guided tours in Berlin:
Reservations for services can be canceled at no charge up to 8 days before the beginning of the event. Following that date, a cancellation fee of 50% shall be charged. The full price shall be charged for cancellations 48 hours before the agreed time and later.

GoArt! tours with further services:
Reservations for services can be canceled at no charge up to 21 days before the beginning of the event. A cancellation fee of 50% shall be charged for cancellation of reservations up to 14 days before the beginning of the event, 75% shall be charged for cancellation 7 to 3 days in advance, and the full price shall be charged for cancellations 72 hours before the agreed time and later.

§ 5 Additional services
Additional services shall be developed on a per-project basis and are therefore subject to separate agreements.

§ 6 Liability
Liability: As an intermediary and organizer, GoArt! is only liable for its own services. Liability beyond this is excluded. GoArt! serves only as an intermediary for all third-party catering, bus and limousine services. Liability claims from these third-party services can only be asserted directly with the respective service provider. Interruptions of services on which the organizer has no effect such as weather, train cancellations and the like shall be borne by the client. Participants do not have additional insurance coverage during tours. Please check your existing insurance policies (health, accident, liability insurance). Claims cannot be assigned to GoArt!. GoArt! reserves the right to cancel the agreement if the smooth operation of business, safety or reputation of GoArt! is jeopardized or in the case of force majeure. No claims for damages can be asserted against GoArt!. The place of performance of all obligations from the contractual relationship is Berlin. The sole place of jurisdiction is Berlin. Different agreements or collateral agreements must be made in writing and confirmed by both contractual parties.
